Christopher D. Schmidt, Neenah, was in court on March 31 on a count of Vehicle Operator Flee/Elude Officer. Court orders: 40 month term of imprisonment - bifurcated sentence. Consecutive to any other sentence being served. 16 month IC / two years ES. 118 days CFTS. ES conditions: AODA and follow through. Six month DL revocation. No operation of any motor vehicles without the approval of the supervising agent. The defendant must maintain absolute sobriety and is prohibited from possessing/ingesting any impairing substances that have not been prescribed by a physician. Defendant to undergo a mental health evaluation and follow through with any recommended treatment within the first 12 months of IC. Costs w/60 DTP or PP. DE is not eligible for the Challenge Incarceration Program or the Substance Abuse program. Appeal rights given.

As to both counts - DE must maintain absolute sobriety, DE prohibited from possessing/ingesting any impairing substances that have not been prescribed by a physician, AODA within the first year of probation and follow through, No contact with Thomas Sagami unless approved by supervising agent. Appeal rights given. Cash bond previously posted to be applied.
