Waushara County Felonies

The Waushara County felonies as recorded from the Waushara County Courthouse are as follows:

• Kyle R. Herr, 21, Neshkoro, appeared in court on Jan. 26 for an initial appearance for Possession of THC (2nd + Offense) and Possess Drug Paraphernalia. A status conference is scheduled for March 7.

• Justin J. Sertle, 26, Princeton, appeared in court on Jan. 26 for a plea/sentencing hearing for five counts Manufacture/Deliver Designer Drugs (<=3g). He received for each count: 6 years and 9 months in Wisconsin State Prison to be served as 33 months initial confinement and 48 months extended supervision, concurrent, conditions of extended supervision to include: drug buy money, AODA and follow through and court costs with DNA surcharge to be paid within 60 days or payment plan.

• Levi S. Stewart, 38, Wautoma, appeared in court on Jan. 26 for a sentencing hearing for two counts Criminal Damage to Property and Disorderly Conduct. A sentencing hearing is scheduled for March 14.

• Michael A. Chmiel, 25, Waupun, appeared in court on Jan. 26 for a sentencing hearing on revocation for Manufacture/Deliver Designer Drugs (<=3g), OWI (2nd), Operate with Restricted Controlled Substance (2nd), Operating While Revoked (Revocation due to alcohol, controlled substance, refusal), two counts Bail Jumping-Felony, Possess Drug Paraphernalia and Manufacture/Deliver Heroin (< 3g). He received: for Manufacture/Deliver Designer Drugs (<=3g): 5 years 6 months Wisconsin State Prison to be served as 30 months initial confinement and 3 years extended supervision with 259 days credit for time served, concurrent to Marquette County 15CF55, conditions of extended supervision to include: AODA and follow through, re-imposed court costs, drug buy money and DNA surcharge; for Manufacture/Deliver Heroin (<3g): 2 years in Wisconsin State Prison to be served as 1 year initial confinement and 1 year extended supervision, consecutive to 15CF129, conditions of extended supervision to include: AODA and follow through, court costs with DNA surcharge and drug buy money; for Operate with Restricted Controlled Substance (2nd): 30 days in Waushara County Jail with 169 days credit for time served, fine and blood draw fee to be paid within 60 days or payment plan, 12 months driver’s license revocation and 12 months ignition interlock device.
